Enterprise Warranty

LIMITED WARRANTY: COMMERCIAL ENTERPRISE CLIENTS

This Limited Warranty (“Warranty”) is provided by Fixitforus Automotive LLC (“Fixitfor.us,” “we,” or “us”) to the party requesting the Service (“Customer,” “You,” “Fleet,” “Enterprise,” “Commercial Enterprise,” “Commercial Enterprise Client”) for automotive or vehicle repair or maintenance services (“Vehicle Services,” “Repair Services”).

Entire Agreement and Amendment

This Agreement contains the entire agreement between the parties, superseding all prior agreements, oral or written, concerning the subject matter of this Limited Warranty. Amendments can only be made through a written instrument executed by both parties.

Limitation of Warranty

EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, FIXITFORUS AUTOMOTIVE LLC MAKES NO REPRESENTATIONS OR WARRANTIES, AND HEREBY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Electronic Signatures

The electronic signatures of the parties included in this Agreement are intended to authenticate this writing and have the same force and effect as manual signatures.

Governing Law

This Agreement will be governed by the substantive laws of the State of Michigan, and all disputes arising under or relating to this Agreement shall be resolved in the State Court located in Michigan. The prevailing party in any legal action shall be entitled to recover reasonable attorneys’ fees.

Severability

If any provision of this Agreement shall be held or made invalid by a court decision, statute or rule, or shall be otherwise rendered invalid, the remainder of this Agreement shall not be affected thereby.

Warranty Coverage

This Limited Warranty extends to the Commercial Enterprise purchaser of Vehicle Services provided by a Technician scheduled through us. We warrant that Vehicle Services will be free from defects in:

  1. Material: Parts replaced during the Vehicle Services.
  2. Workmanship: Vehicle Services performed correctly without significant deviation from standard industry practices or manufacturer’s recommended service procedures.

Coverage extends only to the actual cost of:

  1. Parts Replaced during the vehicle services;
  2. Labor fees charged by us related to the vehicle service where a defect is alleged;

Third-Party repair facility; Financial Liability

In the event that we employ a third-party repair facility to complete warranty work our financial liability shall be limited to the actual amounts paid by you, to us for work completed, that is being remediated under this warranty agreements

When a third-party shop is employed to complete warranty repair work Enterprise is liable for any amounts beyond actual amounts paid; unless an amended agreement is enforce at the time of warranty claim.

Limited Warranty Period

This Limited Warranty is valid for 24 months or 24,000 miles, whichever comes first, from the date of Vehicle Services. Remedial work does not restart the Warranty Period. Any additional warranty coverage will be provided separately.

Additional Manufacturer Warranty

Materials provided by us may have a separate warranty that extends beyond the Limited Warranty Period. Workmanship remains subject to the Warranty Period, unless covered by the manufacturer.

Used, Salvage, or Recovered Parts

If used, salvage, or recovered parts are utilized, the warranty period is limited to 30 days for parts and workmanship. Broker or Seller’s part warranties may extend beyond 30 days; this does not extend our workmanship warranty period of 30 days.

Customer Provided Parts

We do not warrant the correctness of customer-provided parts’ application. We only cover workmanship. Material warranties for customer-provided parts are the responsibility of the customer.

No Further Diagnostics

If the customer provides parts and forgoes additional diagnostic procedures, we make no warranty as to the completeness of the repair and this warranty is void.

Core Charges

Refunds for defects may require the return of the defective part, with any associated core fees deducted.

Claims Under Limited Warranty

If there is a defect within the Warranty Period, Fixitfor.us will, at its option:

  1. Engage our technician(s) to perform remedial service work.
  2. Engage a third-party repair facility.
  3. Refund any amount paid for the Vehicle Services.
  4. Any combination of the aforementioned.

Reimbursement will be limited to actual amounts paid by the Enterprise Client, unless an amended agreement is in place at the time of the warranty claim.

Not Covered Under This Limited Warranty

This Limited Warranty does not cover:

  • Damage caused by abnormal use, misuse, neglect, alteration, or external causes.
  • Vehicle Services contracted to an outside third-party provider (other than Fixitfor.us).
  • Correction of defects not allowed for remediation by Fixitfor.us.
  • Diagnostic or inspection services.
  • Issues unrelated to the ordered Vehicle Services.
  • Pre-existing conditions not known by the Technician.
  • Consequential damage unrelated to defective parts or incorrect repair work.
  • Work completed when the customer provides parts without additional diagnostics.

Voiding of Limited Warranty

This Limited Warranty becomes void when:

  1. Parts not ordered through or approved by Fixitfor.us are installed.
  2. Vehicle Service deviates from a manufacturer’s recommendation.
  3. After receiving Vehicle Services, the Vehicle is taken to a third-party for diagnosis or repair of an alleged warranty defect, without giving Fixitfor.us the first opportunity to inspect and remedy the problem.
  4. Work completed when the customer provides parts without additional diagnostics.

Fees for No Defect

In the event of a claim for a defect with no actual defect, the customer may be charged for:

  • Standard Call-out Fee.
  • One hour of labor.
  • Mileage, tolls, access fees, parking fees.

Fees for No Defect – Third-Party Repair Shop

If a third-party service shop is employed and no defect is found, the Enterprise Customer is fully liable for any fees.

Process for Filing a Claim Under this Limited Warranty

A written claim must be filed at [link to warranty claim] or via [email protected], including:

  1. Date of service.
  2. VIN.
  3. Vehicle Name/Plate Number.
  4. Purchase Order, Case Number.
  5. Specify nature of the claim: workmanship, parts, or both.
  6. Related photographs, if any.
  7. A brief description of damages and circumstances.

Claim Deadline

Claims must be filed within two business days of notice. Failure to report within two business days may void the warranty claim.

Reimbursement and Third-Party Repair Shop Payments

We will attempt direct payment to the third-party repair shop. If direct payment is not possible, we will reimburse you. Reimbursement requires an inspection report or invoice proving the defect and the third-party repair shop contact information. Invoices or inspection reports must contain vehicle identification information and current mileage.

Reimbursement or direct payment to the Repair Provider requires an inspection report or invoice proving the defect. Refunds can be by check, prepaid debit card, direct deposit, or ACH.

Return of Defective Parts

Defective parts replaced under this warranty become our property and are not required to be returned, except when outlined otherwise.

Acceptance

By requesting and accepting Vehicle Services, you acknowledge and accept the terms of this Limited Warranty.
